Purchase terms
Terms for selling collections to Records.de.
These terms apply when Records.de buys records, CDs or related items from private or commercial sellers.

1. Scope
These purchase terms govern the purchase of physical music and related items by Records.de. Conflicting seller terms apply only if Records.de has expressly agreed to them.

2. Enquiry and contract
An enquiry, preliminary assessment or estimate is not a binding purchase offer. A contract is concluded only when the parties agree the final items and purchase price.

3. Information and preliminary assessment
The seller must describe quantity, genres, condition, completeness and relevant defects truthfully. Any assessment based on photos or descriptions remains provisional until the items have been inspected.

4. Ownership and authority
The seller confirms that they own the items or are authorised to sell them and that no third-party rights prevent the sale.

5. Handover, shipping and collection
The method of handover is agreed individually. Items must not be sent without prior agreement. Responsibility for packing, transport and costs follows the specific agreement.

6. Purchase price and payment
The final purchase price is based on the items actually accepted after inspection. Payment is made using the agreed method after the purchase is concluded.

7. Items not purchased
Items that are not included in the purchase are handled, returned or disposed of only as specifically agreed with the seller.

8. Liability
Liability follows applicable law. Records.de does not accept broader liability for incorrect seller information, inadequate packing or risks outside an agreed handover process.

9. Applicable law and jurisdiction
German law applies. Statutory consumer protections and mandatory jurisdiction rules remain unaffected.

10. Consumer dispute resolution
Records.de is neither willing nor obliged to participate in dispute-resolution proceedings before a consumer arbitration board unless required by law.
